1. Acceptance of These Terms

By accessing or using the Services, creating an account, starting a subscription, or otherwise indicating acceptance, you agree to these Terms and to our Privacy Policy, Cookie Policy, Refund Policy, and any additional terms presented for a specific feature, purchase, promotion, or service. If you do not agree, do not use the Services.

If you use the Services on behalf of a company, church, ministry, school, or other organization, you represent that you have authority to bind that organization. Separate institutional, church, enterprise, or content licenses may apply and will control if they conflict with these Terms.

2. About VIVA

VIVA is a digital Bible experience that may include Bible text, dramatized or performed audio Bible content, devotionals, reading plans, playlists, talent and production information, AI-assisted Bible exploration through Compass, voice interaction, video, merchandise, partner resources, and other features that may be added or changed over time.

Certain content is owned by Faith Tech or its affiliates; other content, including Bible translations, performances, music, photographs, names, likenesses, trademarks, and third-party materials, may be licensed from third parties. Nothing in these Terms transfers ownership of any VIVA or third-party intellectual property to you.

3. Eligibility; Minors

You must be at least 13 years old to create your own VIVA account unless a specific VIVA experience is expressly designed for younger users and is accompanied by separate parental-consent and privacy procedures. If you are under the age of legal majority where you live, you may use the Services only with permission of a parent or legal guardian.

A parent or guardian who permits a minor to use the Services is responsible for supervising the minor’s use and for the minor’s compliance with these Terms. Paid subscriptions and purchases by minors must be authorized by a parent, guardian, or other person legally permitted to make the purchase.

4. Accounts and Account Security

Some features require an account. You agree to provide accurate information, keep it current, protect your login credentials, and promptly notify us if you believe your account has been compromised. You are responsible for activity that occurs through your account unless applicable law provides otherwise.

You may not impersonate another person, create accounts for deceptive purposes, sell or transfer your account, scrape account data, or use another person’s account without authorization.

5. Personal License to Use the Services

Subject to these Terms, VIVA grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for lawful, personal, noncommercial use. This license does not include ownership of any content or software.

Unless we expressly authorize it in writing, you may not reproduce, distribute, publicly perform, publicly display, rebroadcast, sell, sublicense, commercially exploit, alter, reverse engineer, remove rights notices from, or create unauthorized derivative works from the Services or VIVA content. Church, ministry, classroom, broadcast, event, public-performance, and institutional uses may require a separate license.

6. Audio Bible, Bible Text, and Licensed Content

Bible translations, audio performances, music, sound design, artwork, photographs, video, and other content may be protected by copyright, trademark, publicity, contract, and other rights. Your subscription or purchase gives you access to content only for the scope and duration stated at purchase; it does not give you ownership of the content.

Offline downloads, if offered, are licensed for use through the Services and may become unavailable when your subscription ends, your account is terminated, a license expires, or the content is withdrawn. You may not extract or redistribute downloaded files outside authorized VIVA functionality.

7. Compass and Other AI Features

Compass and other artificial-intelligence features may generate answers, explanations, summaries, prayers, study prompts, recommendations, translations, or other content based on your requests and on information available to the system. AI-generated content can be incomplete, inaccurate, or inconsistent, and reasonable people and faith traditions may interpret Scripture differently.

Compass is intended as an educational and spiritual-support tool. It is not a substitute for clergy, pastoral counseling, professional medical or mental-health care, legal advice, financial advice, or emergency services. Do not rely on an AI response as the sole basis for decisions involving health, safety, legal rights, finances, or other high-impact matters.

Where Compass cites or quotes Scripture, users should review the underlying Bible text and translation. VIVA may use automated systems, retrieval tools, third-party AI models, and human-authored instructions to produce or improve AI responses.

8. Voice Chat and Conversational Features

If you use Compass Voice Chat or another voice feature, your audio may be transmitted to service providers that provide speech recognition, speech synthesis, communications infrastructure, AI processing, or related functionality. Depending on the feature and your settings, VIVA may generate a live transcript or retain conversation history as described in the Privacy Policy and in-product notices.

We will seek consent where required before recording or persistently storing voice communications. You are responsible for ensuring that any other person participating in a voice session has been informed of, and consents to, any recording or transcription where applicable.

9. Subscriptions, Billing, and Auto-Renewal

Certain features require a paid subscription. Prices, billing periods, included features, taxes, and any introductory offers will be shown before purchase. Unless stated otherwise, subscriptions automatically renew at the end of each billing period until canceled.

If you purchase through Apple, Google, Roku, Amazon, another app store, or another third-party marketplace, billing and cancellation may be administered by that provider and subject to its terms. If you purchase directly from VIVA, the payment method you provide may be charged at each renewal until cancellation.

You may cancel future renewal at any time through the purchase channel used for your subscription. Cancellation generally takes effect at the end of the then-current paid period unless applicable law or the purchase platform requires otherwise. Refund eligibility is governed by the VIVA Refund Policy and, when applicable, the rules of the platform through which you purchased.

10. Trials, Promotions, Coupons, and Gifts

VIVA may offer free trials, promotional pricing, coupons, partner codes, or gift subscriptions. Eligibility, duration, expiration, renewal pricing, and other conditions may vary by offer. Unless expressly stated otherwise, promotional offers may not be combined, transferred, resold, or exchanged for cash.

Gift subscriptions may require the recipient to create an account and accept these Terms. A gift does not guarantee access to every future feature or item added to VIVA.

11. Purchases of Merchandise or Other Products

If VIVA offers physical or digital products, additional checkout terms may apply. Product descriptions, availability, shipping estimates, taxes, and prices may change. Customized or personalized items may be subject to special return or refund restrictions disclosed at purchase.

12. User Content, Prayer Requests, Notes, and Feedback

The Services may allow you to submit text, voice, prayer requests, notes, questions, reviews, profile information, or other material (“User Content”). You retain ownership of rights you have in your User Content. You grant VIVA a non-exclusive, worldwide, royalty-free license to host, process, reproduce, transmit, and display User Content only as reasonably necessary to operate, secure, improve, and provide the Services, subject to our Privacy Policy and your settings.

Do not submit content that you do not have the right to use, that violates another person’s privacy or intellectual-property rights, or that is unlawful, threatening, fraudulent, malicious, sexually exploitative, or intended to harm the Services or another person.

If you voluntarily send ideas, suggestions, or product feedback, you permit VIVA to use that feedback without restriction or compensation, provided that we do not publicly identify you as the source without permission.

13. Community and Sharing Features

If VIVA enables public or group prayer requests, comments, shared playlists, community areas, or social features, information you choose to make public or share with a group may be visible to others. Use care before sharing sensitive personal information. VIVA may moderate, remove, limit, or disable content or accounts when reasonably necessary to enforce these Terms, protect users, or comply with law.

14. Communications

You may receive service-related messages necessary to operate your account, such as security notices, receipts, subscription notices, and changes to the Services. Marketing email, SMS, push notifications, or automated voice communications will be sent only as permitted by law and according to your choices. You can manage many communication preferences in your account or through the instructions in the message.

Consent to receive marketing communications is not a condition of purchasing VIVA. Message and data rates may apply to SMS or mobile communications.

15. Acceptable Use

You agree not to misuse the Services. Prohibited conduct includes:

• using the Services for unlawful, fraudulent, abusive, harassing, or deceptive activity;
• attempting to gain unauthorized access to accounts, systems, source code, APIs, or data;
• interfering with the security, integrity, availability, or performance of the Services;
• using bots, scrapers, automated extraction tools, or data-mining methods except where VIVA has expressly authorized them;
• using VIVA content, transcripts, talent images, voices, names, or likenesses to train, clone, fine-tune, or build an AI or synthetic-media system without written permission;
• circumventing geographic, subscription, technical, or rights-management restrictions;
• uploading malware or attempting to probe or exploit vulnerabilities;
• using the Services to generate or distribute content that infringes rights or materially facilitates wrongdoing; or
• misrepresenting AI-generated material as an official statement of VIVA, a Bible publisher, a pastor, a performer, or another person.

16. Intellectual Property; Trademarks; Talent Rights

The Services and their design, software, databases, audio productions, video, editorial material, logos, trademarks, and other content are owned by or licensed to VIVA and are protected by applicable law. “VIVA,” “¡VIVA! La Santa Biblia,” associated logos, and other brand elements may not be used without permission.

Names, images, voices, performances, biographies, and likenesses of actors, artists, pastors, speakers, crew members, and other participants are provided solely as part of the authorized VIVA experience. No commercial, endorsement, synthetic-voice, impersonation, or publicity use is granted to users.

17. Copyright Complaints

If you believe material available through the Services infringes your copyright, send a notice containing the information required by applicable copyright law to our designated copyright contact. We may remove or disable access to material and may terminate repeat infringers when appropriate.

18. Privacy and Cookies

Our collection and use of personal information are described in the VIVA Privacy Policy. Our use of cookies, mobile SDKs, local storage, pixels, and similar technologies is described in the VIVA Cookie Policy. Privacy choices available to you may vary by jurisdiction and device.

19. Third-Party Services and Links

The Services may integrate with or link to third-party services, including app stores, payment processors, communications providers, AI providers, streaming devices, social networks, websites, and content partners. Third-party services are governed by their own terms and privacy practices. VIVA is not responsible for third-party services that we do not control.

20. Service Availability and Changes

We may update, add, remove, suspend, or modify features, content, supported devices, or technical requirements. We may also perform maintenance or respond to security, legal, licensing, or operational issues. We do not guarantee uninterrupted availability of every feature or item of content.

If a material change affects an active paid subscription, we will provide notice when required by law and may offer any remedy required by applicable law or the applicable purchase platform.

21. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you have materially violated these Terms, created security or legal risk, engaged in fraud or abuse, failed to pay amounts due, or if we are required to do so by law or a platform provider. Where appropriate, we may provide notice and an opportunity to cure.

Sections that by their nature should survive termination—including intellectual-property, payment obligations, disclaimers, limitations of liability, and dispute provisions—will survive.

22. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” VIVA AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI-GENERATED, EDITORIAL, OR THIRD-PARTY CONTENT WILL ALWAYS BE ACCURATE, COMPLETE, OR APPROPRIATE FOR YOUR PARTICULAR CIRCUMSTANCES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVA, FAITH TECH, THEIR AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO VIVA FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED OR EXCLUDED.

24. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless VIVA, Faith Tech, their affiliates, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Services, your User Content, or your material violation of these Terms. This section does not require indemnification for VIVA’s own negligence or misconduct where prohibited by law.

25. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles, except to the extent the law where you live requires otherwise. Unless applicable law requires a different forum, disputes that cannot be resolved informally will be brought in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

Nothing in these Terms limits any non-waivable consumer protection right, privacy right, or other statutory right available to you under applicable law.

26. Changes to These Terms

We may update these Terms to reflect changes in the Services, law, technology, or business practices. We will post the revised Terms with a new effective date and provide additional notice when legally required. If a change materially affects your rights, we may request renewed acceptance.

27. General Terms

If any provision is held unenforceable, the remaining provisions will remain in effect and the unenforceable provision will be enforced to the maximum extent permitted by law. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, reorganization, sale, financing, or transfer of the Services or related business. These Terms, together with incorporated policies and feature-specific terms, are the entire agreement regarding the Services unless a separate written agreement expressly states otherwise.
